These Terms and Conditions (“Terms”) constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and Pivotly (“we,” “us,” or “our”), concerning your access to and use of the pivotly.com website as well as any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the “Service”).

Cap on Liability: Our total liability to you for any cause whatsoever will at all times be limited to the amount paid, if any, by you to us during the six (6) month period prior to the cause of action arising.

- Our Right to Terminate: We reserve the right to, in our sole discretion and without notice or liability, deny access to and use of the Service to any person for any reason, including for breach of any representation, warranty, or covenant contained in these Terms.
- Dispute Resolution (Binding Arbitration)
To expedite resolution and control the cost of any dispute, any legal claim arising out of these Terms shall be resolved by binding arbitration on an individual basis.
- Class Action Waiver: You agree that any arbitration shall be limited to the dispute between us and you individually. To the full extent permitted by law, no arbitration shall be joined with any other proceeding or decided on a class-action basis.
